We typically represent policyholders, though we have on occasion represented an insurer. Our policyholder clients have included contractors and owners involved in suits over defective—or allegedly defective—construction, securities brokers and financial advisers facing claims of negligence or intentional misconduct, and many other types of businesses.
Most of our work involves commercial general liability policies, errors and omissions coverage, and fidelity bonds, but we have also handled cases involving first-party coverage for property damage and business interruption as well as more unusual disputes involving industry-specific insurance policies like media liability coverage.
We are also prepared to address and litigate the insurance coverage issues associated with the hacking of a policyholder’s information systems, whether it results a data breach or simply a loss of information system availability or integrity.
Finally, we have significant experience with complex coverage cases like those dealing with environmental liabilities and toxic torts. These cases involve multiple sites, multiple jurisdictions, significant choice of law issues, multiple policies, and multiple policy periods.
